Justice Athar Minallah ruled that confessions made to the media while in police custody are not admissible as evidence. The court stressed the need for legal safeguards to protect the rights of accused individuals.

ISLAMABAD – The Supreme Court of Pakistan has acquitted an individual accused in the murder of a child in Karachi, ruling that a confession made to the media while in police custody cannot be used as admissible evidence.

Justice Athar Minallah authored a 25-page written verdict in the case, underscoring serious legal and ethical concerns around media access to accused individuals held in custody. The judgment makes it clear that any confession not recorded in the presence of a magistrate carries no legal weight.

"It is no ordinary matter to grant a reporter access to interview the accused, record their statement, and then disseminate it to the public," Justice Minallah noted in the judgment.

The court found that the officer in charge and the investigating officer of the relevant police station had allowed a journalist to interview the accused during his physical remand. Subsequently, an edited version of the interview was broadcast by a private television channel.

Justice Minallah strongly criticized the trend of such media confessions, saying, “This practice is becoming increasingly common and continues unchecked, violating not only the rights of the accused but also those of the victims.” He emphasized that media trials, particularly in high-profile cases, can cause irreparable damage and undermine the integrity of judicial proceedings.

The court ruled that the media statement could not be treated as valid evidence, as it lacked the required legal safeguards — it was neither recorded before a magistrate nor fulfilled the standards of admissibility.

Justice Minallah noted that such actions may be motivated by a desire to demonstrate performance or bow to public pressure, but they are not in the public interest. He further cautioned against the dangers of sensationalizing criminal cases through media coverage that compromises legal rights and due process.

The court ordered that copies of the judgment be sent to the Secretary of the Ministry of Interior, the Secretary of the Ministry of Information and Broadcasting, the Chairman of PEMRA, and all provincial Chief Secretaries. The judgment urged authorities to adopt immediate measures to protect the rights of accused persons and ensure transparency in the investigation and trial process.
